1)Amc policy
1. This contract (“Contract)” is made between Kitessky Technologies Pvt Ltd , and the “Party” and shall come into effect from the contactdate mentioned overleaf when the party has either by himself or through his authorized agent or servant , signed his contract subject tothe there contained herein and on the contract Form2. TERMS OF SERVICE AND PAYMENT:i) the party agree to pay Kitessky the amount mentioned overleaf(“consideration:”) simultaneously with the signing of this Contract. Allpayments should be through specially crossed account payee cheques drawn in favour of “Kitessky Technologies Pvt Ltd”1. The party shall ensure that the cheques shall not bounce under any circumstances2. The Party confirms and represents that the party shat issue stop payment instruction to his bank under any circumstances3. In case of non-adherence of the above , legal action shall be taken in accordance with of the above ,legal action shall be taken inaccordance with the negotiable instruments act, 1881 . without prejudice to Kitessky ’s right to remedy under the negotiable instinstruments act , 1881 ,Kitessky shall be entailed to forthwith terminate this contract and shall be entailed to indemnity in accordanceclause 4 herein bellow3. TENURE OF CONTRACT AND TERMINATION: unless otherwise terminated in accordance with this clause ,this contract shallcommence on the date mentioned overleaf and continue for a period as mentioned on the contract ( the “term”)i. The party shall not , under any circumstances be entitled to terminate this contract during the term or to a refund of the consideration.ii. Kitessky shall be entitled to terminate this contract and withdraw services during the term by written notice of 7 days of the party . INsuch and event, the party shall receive a refund of the consideration on pro rata basis.4. PARTY WARRANTIES AND DECLARATIONS : the party declares and warrants as follows:i. the party can avail services of Kitessky for maintainece of his goods (software and hardware) as mentioned overleafii. only service is free .The party would provide all software and hardware to maintain his Computer or Computer parts or party purchasethem from Kitesskyiii. Party must have to provide information about his problems by Phone call Or other methodsiv. False call or call that does not covered by amc must be compensated by party with visiting charge5. INDEMNITIES: The party shall defend , indemnify and hold Kitessky harmless from any loss, damage ,cost and expenses coursed toKitessky arising out any threatened or actual claim , legal action , proceeding , suit , litigation, prosecution, mediation , arbitration orenquiry by or against Kitessky (including reasonable attorneys fees and expenses and court fee if any ) arising out of or related to :I. Dissemination of the party’s information:II. Breach of any of the terms of the contract by the partyIII. Any inaccuracy, misrepresentation or any breach by party of any of its representations and warranties:The provision of this clause shall survive termination of this contract6. Force Majeure: Kitessky shall not be liable for any delay or non-performance hereof if and to the extent caused by occurrence beyond itscontrol including but not limited to m acts of God , Decrease or restraints of Governments, strikes ,or other labor disturbances, change oflaw refusal on the part of Government, Government agencies, bank or other competent authority to grant any necessary permit7. Jurisdiction and arbitration: all Disputes arising out of this contract which cannot be settled by mutual negotiations , shall be referred toarbitration in accordance with the provisions of the arbitration and conciliation act , 1996 the seat of arbitration shall be in Delhi, Indiathe language used English the arbitration proceedings shall be English . the arbitral award shall be final and binding substantiated inwriting this contract govern by and construed in accordance with the law of India ,any disputes shall be subject to the exclusivejurisdiction of the courts of Delhi
2)Repair PolicyRepair estimate of the parts are suspected, in case during repair if we find some other problems will be treated as a new problem, we will intimate the same then processed.
Physical verification of the material is only possible when it reaches to our workshop.
All Software's and Data are of client responsibility, please backup all the data before submitting for repair.
All repairs of Laptop / Desktop / Printer / Monitor are warranted for 15 days from date of Closed Call.
This warranty applies only to those items which were found defective and repaired, it does not apply to products in which no defect was found and returned as is or merely recalibrated. Out of warranty products may not be capable of being returned to the exact original specifications or dimensions.
In case of repeat issue/problem we can only be able to give service on address provided at the time of call logged.
In no event will we be liable for any loss or damage including, without limitation, indirect or consequential loss or damage, or any loss or damages whatsoever arising from use of parts or loss of use of, data or profits arising out of, or in connection with.
All on-site services and response times are subject to the following conditions:Performed during Standard Business Hours.Availability of the services in your area, and the availability of technicians in your area.Availability of parts.Replacement Policy: No advance replacement will be issued unless the faulty is returned.Computer Parts are likely to come from a different manufacturer and/or store, For any hardware defects you will have to deal with the appropriate manufacturer company If you want, on behalf of you we will provide the replacement service(pick n drop) on chargeable basis as per manufacturer terms.
Payment Terms: Diagnosis fees at the time of Pick-up, remaining at the time of delivery or completion of work. No credit is available.
Diagnosis Fee: This fee applies to all out-of-warranty service requests with no exception. It is payable even if we determine that the laptop is not faulty; that the fault is not repairable; or you decide not to proceed with the repair. However, it may be waived at our discretion if you instruct us to proceed with the quoted repair or if the laptop is salvaged to kitessky technologies Pvt Ltd.
Payment: Full payment is strictly due on collection of your laptop. Your laptop will not be returned to you until full payment is received. You can make payment by cash or bank cheque. Personal cheques and company cheques are not accepted without prior arrangement. We retain a security interest in your laptop until full payment is made and we retain the right to sell your laptop at a private or public sale to pay for any outstanding invoice if payment is not received within 30 days of its due date.
Cheque Return Charges: for any financial reason – INR 350 for one cheque.
Customer’s Responsibilities Software/Data Backup. It is the Customer’s responsibility to complete a backup of all existing data, software, and programs on Supported Products prior to performing any Services. WE WILL NOT BE RESPONSIBLE FOR LOSS OF OR RECOVERY OF DATA, PROGRAMS, OR LOSS OF USE OF SYSTEM(S) OR NETWORK. You understand and agree that under no circumstances will Penta IT be responsible for any loss of software, programs, or data, even if our technicians have attempted to assist you with your backup, recovery, or similar services. Any such assistance is beyond the scope of any Penta IT warranty and this Service Agreement. The assistance is provided in our sole discretion and without any guarantee or warranty of any kind. Neither does we provide any guarantee or warranty of any kind with respect to any third-party product that our technician may use in assisting you.
Technical description of the defect: In order to properly repair a product, it is absolutely necessary for KITESSKY TECHNOLOGIES PVT LTD to receive information specifying the reason the product is being returned. Specific test data, written observation on the failure and specific corrective action you require, is needed.
